Researches with plant extracts and their derivatives: what results can be protected by the patent system?

The article describes the importance of plants for current society, emphasizing the relevance of the protection of research results in this area by Patent System. It also points out the necessity to diffuse the culture about patents in Brazil and presents a summary on fundamental topics associated to the present theme. Then, this work analyzes the legislations associated to the patents in Brazil, in the United States of America, in the European Community and in Japan, in order to verify which research results concerning plant extracts and their derivatives are susceptible to protection according the aforementioned legislations. Finally, the present work observes that the same ones grant protection in different levels and that, in this area, each result should be analyzed in particular way, depending on the country wherein the protection will be requested.
